Even when treatment is paid along the way, that does not always mean the money is “free.” A health insurer, MedPay carrier, or other payer may later assert a reimbursement or subrogation claim against the settlement. The California Department of Insurance specifically notes that health insurers often try to recover what they paid, and describes subrogation as the effort by one insurer to get money back from another responsible source.
