Our 78-year-old client, who is legally blind, was riding in the front passenger seat of his wife’s vehicle with his guide dog in the back when another driver failed to yield while making a left turn. The impact was severe enough to deploy the airbags and total their vehicle. Although the responding officers determined that the other driver caused the collision, she later gave a different account to her insurance company — something we see quite often once some time passes and the at-fault driver realizes their insurance rates may go up. As a result, the carrier initially denied liability and refused to accept responsibility.
